Terms of Service

1. Who we are

Flex Coach ("we", "us", "Flex Coach") operates the website at flexcoach.fit and the related coaching marketplace. Contact: andrew.flexcoach@gmail.com.

2. The service

Flex Coach is a marketplace that connects independent personal trainers ("Coaches") with clients ("Trainees"). Coaches set their own prices, programs, and policies. Flex Coach is not a party to the coaching relationship and is not a healthcare or medical provider.

3. Eligibility

You must be at least 18 years old to use Flex Coach. By creating an account you represent that you meet this requirement and that the information you provide is accurate.

4. Health disclaimer

Exercise involves risk of injury. Coaches on Flex Coach are not medical professionals unless they specifically state otherwise and are licensed in your jurisdiction. Consult a physician before starting any new exercise program. You participate at your own risk.

5. Coach obligations

Coaches agree to: (a) hold any certifications they advertise; (b) deliver the services they promise to clients; (c) not provide medical advice; (d) maintain a Stripe Connect account in good standing; (e) comply with all applicable laws including consumer protection laws; (f) pay the platform subscription fee and the 10% platform fee on coaching revenue collected through Flex Coach.

6. Trainee obligations

Trainees agree to: (a) provide accurate information on intake forms; (b) pay all fees owed to Coaches; (c) cancel a subscription before billing if they no longer want it.

7. Payments & fees

All payments are processed by Stripe. Coaches pay $39 per month for the platform subscription and Flex Coach takes a 10% application fee on each coaching subscription. Stripe processing fees apply on top of platform fees and are passed through.

See our Refund Policy for details. In short: refunds are at the Coach's discretion. Flex Coach platform fees are non-refundable except where required by law.

9. Suspension & termination

We may suspend or terminate any account that violates these Terms, abuses other users, posts illegal or harmful content, or attempts to defraud the platform. We may remove content at our discretion. You may close your account at any time by emailing us.

10. Intellectual property

Coaches retain ownership of the content they upload. By uploading content, you grant Flex Coach a worldwide, non-exclusive license to host, display, and deliver the content to the Trainees you authorize. You are responsible for having the rights to anything you upload.

11. Limitation of liability

To the maximum extent permitted by law, Flex Coach is not liable for any indirect, incidental, special, or consequential damages, or for personal injury arising from the use of any program. Our total liability is limited to the fees you paid to Flex Coach in the 12 months preceding the claim.

12. Dispute resolution

You agree to first contact us at andrew.flexcoach@gmail.com to attempt informal resolution. These Terms are governed by the laws of the State of Delaware, USA, and any disputes will be resolved in the courts of that jurisdiction.

13. Changes

We may update these Terms. Material changes will be announced by email or in the app. Continued use after changes constitutes acceptance.
